1. Introduction
These Terms of Service ("Terms") govern your access to and use of Urithi (the "App"), a language learning application developed and operated by Fredrick Mokua Jaoko, an individual developer based in Nairobi, Kenya ("we," "us," "our").
By downloading, accessing, or using Urithi, you agree to be bound by these Terms. If you do not agree, please do not use the App.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to create an account and use Urithi. If you are under the age of majority in your jurisdiction, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
3. Your Account
- You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You agree to provide accurate and complete information when creating your account and to keep it up to date.
- You must notify us promptly at hello@urithi.app if you become aware of any unauthorized use of your account.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Use of the App
You agree to use Urithi only for lawful purposes and in accordance with these Terms. You agree not to:
- Copy, reverse-engineer, decompile, or attempt to extract the source code of the App, except where permitted by law
- Use the App to transmit any content that is unlawful, abusive, harassing, defamatory, or infringes on the rights of others
- Attempt to gain unauthorized access to the App, other users' accounts, or our systems
- Use automated means (bots, scrapers) to access the App without our prior written consent
- Interfere with or disrupt the App's operation, servers, or networks
- Use the App for any commercial purpose not expressly permitted by us
We reserve the right to suspend or terminate your access if we reasonably believe you have violated these Terms.
5. User-Generated Content
If Urithi allows you to submit content (e.g., written exercises, journal entries, community posts):
- You retain ownership of the content you submit.
- By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, reproduce, and display that content solely for the purpose of operating and improving the App (e.g., displaying your progress, providing feedback).
- You are solely responsible for the content you submit and confirm that it does not violate any third party's rights or applicable law.
- We reserve the right (but do not assume the obligation) to remove content that violates these Terms.
6. Subscriptions and Payments
- Some features of Urithi may require a paid subscription or one-time purchase ("Paid Features").
- Payments are processed through the applicable app store (Google Play, Apple App Store) or a third-party payment processor. We do not directly store your full payment card details.
- Subscription prices, billing cycles, and available plans will be clearly displayed within the App before purchase.
- Cancellations and refunds: Subscriptions can typically be cancelled through your app store account settings. Refunds are subject to the policies of the relevant app store (Google Play or Apple App Store), and we do not directly control refund decisions made by those platforms.
- We reserve the right to change our pricing, but we will provide reasonable notice before any changes take effect for existing subscribers.
7. Intellectual Property
- The App, including its design, text, graphics, logos, course content, and underlying software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.
- We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial use, subject to these Terms.
- You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.
- "Urithi" and associated logos are our trademarks. You may not use them without our prior written permission.
8. Third-Party Services
The App may use or link to third-party services (e.g., analytics providers, payment processors, sign-in providers). We are not responsible for the practices or content of these third parties, and your use of them is subject to their own terms and privacy policies.
9. Disclaimers
- The App is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not guarantee that the App will be uninterrupted, error-free, or completely secure.
- Urithi is an educational tool intended to support language learning; we make no guarantee of specific learning outcomes, fluency levels, or exam results.
10. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising from or related to your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us, if any, in the 12 months preceding the claim.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law.
11. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.
12. Termination & Account Deletion
- You may stop using the App and delete your account at any time. To request permanent account and data deletion, email us at hello@urithi.app or visit our Account & Data Deletion page.
- We may suspend or terminate your access to the App at our discretion, including if you violate these Terms, engage in fraudulent or abusive behaviour, or if required by law.
- Upon termination, your right to use the App will immediately cease. Provisions of these Terms that by their nature should survive termination (e.g., intellectual property, limitation of liability, indemnification) will continue to apply.
13. Changes to the App and These Terms
- We may update, modify, or discontinue features of the App at any time, with or without notice.
- We may revise these Terms from time to time. If we make material changes, we will notify you through the App or by updating the "Last Updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Kenya, unless applicable consumer protection law in your country of residence requires otherwise.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
